Yes indeed.
I think the point is that you can make a contract in all sorts of ways. If I say "Mike, lend me $500 till next month" and you say "Sure, Chris, but you must repay it then" and I say "Agreed" and you hand over the money, I'm legally obliged to pay it back. But it's hard to enforce without witnesses or paperwork.
I am currently cutting a puzzle from a copy of a digital image sent to me by the artist, by email. At this point we have an agreement, by email, that I can cut the puzzle as a demonstration piece for her to see, and if she likes it we could talk about selling puzzles made from her artwork.
I don't expect her to sue me when she receives the puzzle on the grounds that the emails are not a valid agreement. And I'd be surprised if a court ruled otherwise.
